2. Website information is not individualized care

The website provides general information about Birdwalk, its providers, services, perspectives, media appearances, speaking activities, and inquiry process.

Website content is for general informational and educational purposes. It is not a diagnosis, treatment recommendation, occupational therapy evaluation, psychotherapy service, medical opinion, legal opinion, or substitute for individualized professional care.

Do not rely on website content to make urgent health, mental-health, safety, educational, financial, or legal decisions.

3. No therapist-client or provider-client relationship

Viewing the website, submitting the Start Here form, sending an email or text message, or leaving a voicemail does not create a therapist-client, provider-client, consultant-client, or other professional relationship with Birdwalk or any Birdwalk provider.

A professional relationship begins only after Birdwalk confirms that services are available and appropriate and the required intake, consent, service, scheduling, and financial arrangements have been completed.

Submitting an inquiry does not guarantee:

  • Acceptance as a client
  • Provider availability
  • A particular service or provider
  • A specific appointment time
  • Eligibility for telehealth
  • Insurance reimbursement
  • Self-Determination Program authorization or funding
  • Any particular clinical, functional, educational, relational, or design outcome

4. Emergencies and crisis support

This website, the Start Here form, voicemail, text inbox, and email are not monitored for emergencies.

Call 911 for immediate danger or a medical emergency. Call or text 988 for mental-health crisis support in the United States.

Do not use the website or its contact methods when an immediate response is needed.

5. Start Here inquiries

The Start Here form collects limited information to help Birdwalk understand and route an initial inquiry.

Please provide accurate information and use the form only for legitimate inquiries. The form is not intended to collect a complete medical, mental-health, developmental, educational, treatment, or legal history.

Submitting information concerning another person represents that you are authorized to do so, such as when acting as a parent, legal guardian, caregiver, or authorized organizational representative.

Children under 13 should not submit information directly through the website. A parent or legal guardian should make the inquiry.

6. Communications

If you submit an inquiry, you authorize Birdwalk to respond using the contact information and preferred contact method you provide.

Email, voicemail, and ordinary text messaging may not be completely secure. General email and text communications should not include private health information or detailed clinical histories.

Submitting an inquiry does not enroll you in promotional or marketing communications.

7. Services, location, and licensure

Services depend on provider availability, professional scope, client location, applicable licensure rules, clinical or service appropriateness, and fit.

In-person services are offered from Birdwalk’s Arcadia, California location and, where appropriate, at other consultation or project locations.

Telehealth or virtual services may be offered only when permitted by applicable law and professional licensing requirements. Birdwalk may need to confirm the client’s physical location before or during a telehealth service.

Website descriptions do not promise that every service is available in every location or to every person.

8. Private pay, insurance, and funding

Birdwalk Therapy Collective is a private-pay practice and does not bill commercial insurance directly.

Information about fees, superbills, reimbursement, benefits, funding, or Self-Determination Program participation is general and may change. Birdwalk does not guarantee reimbursement, authorization, benefit eligibility, or payment by an insurer, regional center, fiscal-management service, school, employer, or other third party.

Any individualized fee, payment, cancellation, refund, or funding terms will be provided separately when services or projects are discussed or arranged.

9. Sensory-informed design information

Descriptions, photographs, examples, recommendations, and discussions concerning sensory spaces are illustrative.

Every home, school, workplace, organization, user, budget, structure, and project presents different needs and constraints. Recommendations require individualized review and may depend on measurements, safety considerations, building requirements, accessibility, installation conditions, product availability, professional input, and other factors.

Nothing on the website constitutes architectural, engineering, construction, code-compliance, or legal advice.

10. Intellectual property

Unless otherwise stated, the Birdwalk website, Birdwalk name, logo, text, layout, graphics, original photographs, and other Birdwalk-created content are owned by or licensed to Birdwalk Therapy Collective and are protected by applicable intellectual-property laws.

You may view and print website content for personal, noncommercial use. You may not reproduce, publish, modify, distribute, sell, license, scrape, or commercially exploit Birdwalk content without prior written permission.

Third-party names, logos, podcast artwork, publication titles, conference materials, trademarks, photographs, and linked content remain the property of their respective owners. Their appearance on the website does not imply ownership, sponsorship, or endorsement beyond the relationship accurately described.

11. External links and third-party services

The website may link to or embed services operated by third parties, including Shopify, Jotform, media outlets, podcast platforms, professional organizations, social-media platforms, maps, and other resources.

Birdwalk does not control third-party websites, availability, security, accessibility, content, advertising, terms, or privacy practices.

A link does not necessarily mean that Birdwalk endorses every statement, product, advertisement, or service appearing on the external website.

Use of third-party services is subject to their own policies and terms.

12. Acceptable use

You may not use the website to:

  • Violate applicable law or another person’s rights
  • Submit false, fraudulent, abusive, harassing, or misleading information
  • Impersonate another person or misrepresent your authority
  • Upload or transmit malicious code
  • Attempt unauthorized access to the website, forms, systems, accounts, or data
  • Interfere with website operation or security
  • Collect information about other visitors
  • Use automated systems to scrape, copy, overload, or disrupt the website
  • Use Birdwalk content or branding in a manner that falsely suggests affiliation, endorsement, or professional authorization

Birdwalk may restrict access, disregard submissions, or take protective action when misuse is suspected.

13. Website availability and accuracy

Birdwalk aims to provide accurate and useful information but does not guarantee that all website content is complete, current, error-free, or continuously available.

Services, credentials, scheduling, fees, provider availability, policies, links, and website features may change.

Birdwalk may correct errors, update content, suspend features, or discontinue portions of the website without notice.

14. Disclaimer of warranties

The website is provided on an “as available” basis for general informational purposes.

To the fullest extent permitted by law, Birdwalk disclaims warranties concerning the website’s uninterrupted operation, accuracy, completeness, security, fitness for a particular purpose, and freedom from technical errors.

This section does not limit professional duties, warranties, rights, or remedies that cannot legally be disclaimed and does not alter obligations Birdwalk owes to an established client under applicable law or a separate written agreement.

15. Limitation concerning website use

To the fullest extent permitted by law, Birdwalk is not responsible for indirect, incidental, special, consequential, or similar damages arising solely from use of, inability to use, or reliance on the public website or an external link.

This limitation does not apply where prohibited by law and does not limit liability arising from professional services provided to an established client, a separately executed service agreement, gross negligence, intentional misconduct, or duties that cannot legally be limited.

16. Privacy

Use of the website is also subject to Birdwalk’s Privacy Policy:

/policies/privacy-policy

The Privacy Policy explains how website and inquiry information may be collected, used, disclosed, and retained.

If you become a client, additional privacy notices, informed-consent documents, confidentiality obligations, and recordkeeping terms may apply.

17. Separate service agreements

These website terms do not replace:

  • Informed-consent documents
  • Clinical intake agreements
  • Telehealth consent
  • Financial and cancellation policies
  • Good Faith Estimates
  • Sensory-informed design proposals or contracts
  • School, workplace, agency, or organizational agreements
  • Privacy notices and recordkeeping policies
  • Any other written agreement issued for a specific service

If a separate written agreement conflicts with these website terms regarding an established service relationship, the specific written agreement governs that service relationship.

18. Changes to these terms

Birdwalk may update these terms as the website, services, technology, or legal requirements change.

The revised terms will be posted on this page with an updated effective date. Continued website use after an update constitutes use under the revised terms.

19. Governing law

These terms and disputes concerning use of the public website are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any legal proceeding concerning only use of the public website will be brought in a court with appropriate jurisdiction in Los Angeles County, California, unless applicable law requires otherwise.

This section does not change a client’s rights or the requirements governing a professional licensing complaint, regulatory proceeding, health care dispute, or other matter controlled by applicable law.
